T&C and Privacy Statement

Terms and Conditions

Promotional Period 

  

  • This promotion (“Promotion”) is promoted by Faisandier Group Limited, company number 7185034 (“the Promoter”).   

  • The contact person for the Promoter is Simon Faisandier (phone 0212844439). 

  • The Promotion runs from 00.01 am on 20 September 2024 and closes at 11.59pm on 23 December 2024 (“Promotional Period”).   

  • The Promotion is open to any person or entity eligible to purchase residential land under the Overseas Investment Act 2005.  

  • Employees and contractors of the Promoter and its related entities are not eligible to enter the Promotion. 

 

Method of Entry

  • The Promotion is open to every purchaser of a residential property from Faisandier Group Limited or one of its related entities (each a “Purchaser”) who: 

  1. has a confirmed offer and has paid the deposit due under the Agreement for Sale and Purchase, or such other amount as may be agreed with the Promoter in writing, either: 

  1. at the commencement of the Promotional Period; or 

  1. at any time during the Promotional Period; and 

  1. completes settlement within 10 working days of receiving a settlement notice (which will occur after the Promotional Period and no later than 20 September 2026) from the Promoter’s solicitor, or such other timeframe as may be agreed with the Promoter in writing (“Settlement)”, 

each being an “Eligible Purchase”.  

  • The Purchaser will receive one (1) entry into the prize draw for each Eligible Purchase.  

  • Where a Purchaser is more than one individual (e.g. two joint tenants), their Eligible Purchase will give them only one (1) entry into the prize draw.

Prize 

​ 

  • There is one (1) prize to be won, being a cash-back payment to the value of ten thousand dollars ($10,000.00) (“Prize”).  

  

Winner 

  

  • The winner of the Promotion (“Winner”) will be drawn from all Eligible Purchasers no later than 28 February 2025 (“Prize Draw”).   

  • The Winner will be drawn by a random name generator operated by a third party. 

 

Eligibility of the Winner to claim the Prize 

  • Although the Winner will be drawn and notified by 28 February 2025, the Prize will not be paid until Settlement.   

  • To claim the Prize, Settlement must be completed by 20 September 2026. 

  • If Settlement has not been completed by 20 September 2026, the Winner will forfeit the Prize and a winner will be redrawn on the same terms as the original Prize Draw. 

  • The Prize will be paid by:  

  1. Credit against the purchase price payable by the Winner on Settlement; or  

  1. If the Prize is redrawn, bank transfer to the Winner’s solicitor’s nominated bank account within 15 working days of the redraw Prize Draw. 

 

How the winner will be notified 

  • The Winner will be notified via their contact details provided to the Promoter in connection with the Eligible Purchase.  

  • In the event that the Winner has not provided their contact details or cannot be contacted directly (i.e. cannot be reached by telephone and/or does not respond to email) within 48 hours of the Prize Draw, they will be notified via their legal representative as listed on the Agreement for Sale and Purchase for the Eligible Purchase.   

  • If no response is received from either the Winner or their legal representative within one (1) week from the Prize Draw, a winner will be redrawn on the same terms as the original Prize Draw.  

 

Exclusions and Liability 

 

  • The Promoter will not be responsible for any tax, interest, or other fees payable by the Winner in connection with the Prize.  

  • The Promoter and its related entities, employees, and agencies shall not be liable for any loss, damage, or personal injury suffered by any person arising directly or indirectly out of or in connection with entering the Promotion or claiming/winning the Prize, except to the extent required by law.  

 

Use of Personal Information 

  

  • By entering the Promotion, all entrants (whether Eligible Purchasers or not) consent to the use of their personal information in connection with the Promotion as set out in these terms and conditions and the Promotion Privacy Statement which can be accessed [here].  

  • All personal information (as defined in the Privacy Act 2020 (“the Privacy Act”)) collected in the course of the Promotion will be handled by the Promoter in accordance with the Privacy Act.   

  • The Promoter will use Purchasers’ personal information to conduct the Promotion. 

  • The Promoter may also use Purchasers’ personal information for its own future promotional and publicity purposes.  

  • For the purposes of notifying the Winner, the Promoter pay pass the Winner’s contact details on to its agency and/or solicitor. 

  

General Terms  

  

  • The Promotion is not in any way sponsored, endorsed, or administered by, or associated with, any social media platform used to promote, advertise, or otherwise facilitate the Promotion, including without limitation Facebook.  

  • The Promotion is not in any way sponsored, endorsed, or administered by, or associated with, any third party website used to promote, advertise, or otherwise facilitate the Promotion. 

  • By entering the Promotion you agree to be bound by these terms and conditions.  

  • The Promoter reserves the right to invalidate any entry for non-compliance with these terms and conditions.  

  • The Promoter reserves the right to change these terms and conditions and any other aspect of the Promotion at any time during the Promotion, at its sole discretion. 

  • The Promoter reserves the right to verify the validity of entries and disqualify any entry or refuse to award the Prize where false or misleading information has been given or the entrant has behaved in a fraudulent or dishonest manner.  The Promoter’s decision will be final.  

  • These terms and conditions are governed by the law of New Zealand.  

Privacy Statement 

INTRODUCTION

Faisandier Group Limited and its related entities (“we” / “our”) is committed to protecting personal information and privacy rights generally.  

 

This privacy statement (Statement) explains how and why we collect, store, use, and disclose your personal information in connection with the ‘$10,000 Spring Cash-back’ promotion (Promotion).   

 

By entering the Promotion, enquiring about the Promotion, enquiring about purchasing a residential property from Faisandier Group, purchasing a residential property from Faisandier Group, accessing our Promotion website and/or social media pages, and/or corresponding with us about the Promotion you consent to us dealing with your personal information in accordance with this Statement.  You also agree to receive marketing communications from us, although you can unsubscribe from these at any time.  

 

When we refer to personal information throughout this Statement, we mean personal information as defined in the New Zealand Privacy Act 2020 (Privacy Act), being any information about an identifiable individual (Personal Information).   

PERSONAL INFORMATION we COLLECT  

 

We will collect Personal Information about you when you enter the Promotion, enquire about the Promotion, enquire about purchasing a residential property from Faisandier Group Limited, purchase a residential property from Faisandier Group Limited, access our Promotion website and/or social media pages, and/or correspond with us about the Promotion (including through website forms, email, and telephone).  This will include, but is not limited to, your name, date of birth, address, and contact details.  

 

When you visit our website, we do not automatically collect any Personal Information about you. However, we do collect information that does not identify you for the purposes of improving our service to you. This website information is collected by: 

  • Using cookies; 

  • Collecting website use information including user location, and internet protocol (IP) addresses; and 

  • Analytical tools that we may operate, including but not limited to Google Ads and Google Analytics.  Google has its own privacy policy, which you are recommended to read here.  

A cookie is a small text file that our website may store on your device, which helps us improve your user experience when you use our website. Cookies will not collect identifiable information about you, but will identify your device. 

 

We may use and share this website information with third parties, as set out below. 

 

If you do not want to provide us with your Personal Information 

 

If you do not want us to collect, or to provide us with, your Personal Information you will not be able to enter the Promotion, we may be unable to communicate with you, and we may be unable to provide you with an optimal experience of our Promotion website and social media pages. 

 

Additionally, you can modify the security settings in your internet browser to disallow the placement of Cookies on your electronic device, although this may impact your experience of our website. 

 

We will collect Personal Information directly from you wherever possible.  We may also collect Personal Information from third parties where you have authorised us to do so (including through our agents and solicitor).  

 

USE OF PERSONAL INFORMATION  

We may use your Personal Information that we collect to: 

  • confirm your identity and your eligibility to enter the Promotion (in accordance with the Terms and Conditions of the Promotion); 

  • process and manage your entry into the Promotion; 

  • to operate the Promotion; 

  • deliver information about the Promotion to you; 

  • notify you about any changes to the Promotion; 

  • respond to any issues, concerns, or questions regarding the Promotion;  

  • communicate with you about future promotions, property developments, services, specials and giveaways (this may include using your email address to communicate about these directly);  

  • for statistical and analytical purposes (including sales analysis and audience segmentation); and to 

  • fulfil our legal and regulatory obligations. 

Contacting you by email 

We may send you information by email, including marketing communications about other developments and promotions after the Promotion has ended.  Marketing communications you receive by email will have instructions for how you can remove yourself from that mailing list.  If you ask to be removed from a mailing list, we will do so.  
 

DISCLOSURE OF PERSONAL INFORMATION 

We will not sell, lend, trade or otherwise disclose your personal information to any other person or agency except for the purposes for which it was collected, and for directly related purposes (including those required by law), including but not limited to when:  

 

  • you have authorised us to do so; 

  • it is shared with our agents or service providers who we engage to perform services on our behalf in conjunction with our developments and/or the Promotion and/or any future development and/or promotion, including, but not limited to our solicitor, real estate agents, marketing and social media providers; email service providers;  

  • it is shared with third parties in connection with our developments and/or the Promotion including mortgage brokers and banks; 

  • to carry out marketing; 

  • we believe that the disclosure is reasonably necessary to enforce any legal rights that we may in relation to the Promotion;  

  • the information anonymised and is necessary for us to disclose to enable us to use third party services such as Google Analytics; 

  • it is necessary to resolve a complaint you make about us or the Promotion; and/or 

  • in an emergency situation it is necessary to share your Personal Information with an emergency service.  

 

ACCURACY AND RETENTION OF PERSONAL INFORMATION 

We will only retain Personal Information for as long as is required for the purpose/s for which it may lawfully be used.  Once Personal Information is no longer required, we will securely destroy it.  

We will take steps reasonable in the circumstances to ensure that your Personal Information is accurate, up to date, complete, relevant, and not misleading before using or disclosing it in accordance with this Statement. 

STORAGE AND SECURITY 

We take the security of your Personal Information seriously and comply with their legal obligations to protect your Personal Information, except in a limited number of circumstances as required by the law. 

We have taken reasonable steps to ensure the safety of your Personal Information stored in both electronic and hard copy format, and to protect against loss, unauthorised access, use, modification, disclosure, or other misuse.  We will not divulge your Personal Information except in accordance with normal legal requirements and practices, including the ways that we have covered in this Statement.

NOTIFIABLE PRIVACY BREACHES  

If your Personal Information is involved in a privacy breach which we reasonably believe has caused or is likely to cause serious harm to you (“a Notifiable Privacy Breach”), we will inform you and recommend what steps you should take in response. We will also report a Notifiable Privacy Breach to the Office of the Privacy Commissioner
